Terms of Service

1. Acceptance

By configuring, activating or using Kezli Tier Battle, you agree to these Terms and to any Twitch rules that apply to your use of Twitch and Twitch Extensions. If you do not agree, do not use the service.

2. What the service does

Kezli Tier Battle allows a broadcaster to create a Tier Battle, configure tiers and items, optionally upload item images, run rounds during a Twitch stream, receive viewer votes, hide chat results until reveal, compare Streamer vs Chat results and edit the battle while live.

Features may change as Kezli improves the service. The current Free V1 does not include paid functionality.

3. Broadcaster responsibilities

Broadcasters are responsible for the text, images, tier names and other content they add to a Tier Battle. You must have the rights necessary to upload and display that content.

You must not use the service to upload or display content that:

• infringes copyright, trademark, privacy or other rights;
• is unlawful, fraudulent, malicious or intentionally harmful;
• violates Twitch's Terms, Community Guidelines or Extension rules;
• attempts to compromise Kezli, Twitch or another user's systems.

4. Viewer participation

Viewers may vote on the tier assigned to the current item while the round is open. A viewer may change their current vote before the round is locked where the product allows it.

Kezli may use a Twitch-provided opaque viewer identifier to enforce one current vote per viewer per item and to operate the voting flow.

5. User content and licence

You retain ownership of content you provide. By submitting content to Kezli Tier Battle, you grant Kezli a limited, non-exclusive licence to host, store, process, resize, transmit and display that content only as reasonably necessary to operate and improve the service.

This licence ends when the content is deleted from the service, subject to reasonable backup, security or legal retention.

6. Kezli intellectual property

The Kezli name, software, interface, visual design, source code, workflows and original service content are owned by or licensed to Kezli and are protected by applicable intellectual-property law.

These Terms do not transfer ownership of Kezli technology to users.

7. Twitch

Kezli Tier Battle is an independent extension built for Twitch. It is not Twitch itself and is not presented as being owned, sponsored or endorsed by Twitch unless Twitch expressly states otherwise.

Twitch may separately process information and enforce its own rules. Your use of Twitch remains governed by Twitch's terms and policies.

8. Availability and changes

We aim to keep the service available, but availability is not guaranteed. We may maintain, modify, suspend or discontinue features when reasonably necessary for security, reliability, legal compliance or product development.

We may also limit abusive or automated use that threatens the service or other users.

9. Free service and future paid features

The current Tier Battle Free V1 is provided without a paid subscription. Kezli may introduce usage limits, paid plans or premium features in the future.

Any future paid terms, prices or limits will be disclosed before they apply. Nothing in these Terms charges you for features that are currently free.

10. Privacy

Our processing of personal data is described in the Privacy Policy.

11. Disclaimer

The service is provided on an "as available" basis. To the maximum extent permitted by applicable law, Kezli does not guarantee uninterrupted availability, error-free operation or compatibility with every device, browser or future Twitch change.

Nothing in these Terms excludes guarantees or rights that cannot legally be excluded, including mandatory consumer rights where applicable.

12. Liability

To the maximum extent permitted by law, Kezli is not liable for indirect or consequential losses resulting from outages, third-party platforms, broadcaster-provided content or misuse of the service.

This limitation does not apply where liability cannot lawfully be limited or excluded.

13. Suspension or termination

We may suspend or restrict access where reasonably necessary to address abuse, security risks, legal requirements, Twitch policy violations or material breaches of these Terms.

Broadcasters may stop using the service by deactivating or uninstalling the Extension from Twitch.

14. Governing law

These Terms are governed by French law, without depriving consumers of mandatory protections that apply in their country of residence.

15. Changes to these Terms

We may update these Terms when the product, business model, providers or legal requirements change. The latest version will remain available at this URL with its update date.
